Job Summary 

The Belmont Police Department seeks a dedicated and experienced Police Officer or Bar-Certified Attorney to join our team as a Full-Time Police Prosecutor. The Prosecutor provides legal services to the Belmont Police Department that may include prosecuting cases at the District Court level, research, all aspects of litigation, policy review, acting as legal advisor to the Chief of Police, and training regarding current issues. The Prosecutor is a non-union position and will be a member of the Command Staff. 

Supervision Received 

Works under the direct supervision of the Chief of Police 

Supervision Exercised 

Supervises directly, or through subordinate supervisors, law enforcement staff, support and clerical employees. Provides training, instruction, and guidance to department personnel and evaluates the quality of initial reports submitted. Will act as the liaison between the Courts and the Chief of Police Department. Will act as the department’s legal advisor during criminal-related incidents and/or emergencies. 

Examples of Essential Duties (The listed examples are illustrative only, and may not include all duties found in this position.) 

1. Prepares and litigates in District Court. Participates in criminal arraignments, bail hearings, and probable cause hearings on felonies. 

2. Prosecutes Administrative Action hearings at the Department of Safety 

3. May prosecute juvenile cases 

4. Reviews list of cases for completeness including witnesses, subpoenas, records, and prior convictions 

5. Files motions, informs court if the defendant has complied with previous conditions of his/her sentence 

6. Acts as legal advisor to the Chief of Police on department and technical issues 

7. May act as a legal advisor to town departments as requested by the Chief of Police 

8. Prosecutes civil commitments, requests psychological evaluations, prepares documents regarding competency to stand trial and allegations of dangerousness 

9. Trains and supervises police officers in criminal law and procedures; assists with cases; reviews reports and hearings; makes bail and sentencing recommendations. Provides guidance to enforcement personnel on a 24-hour basis 

10. Responsible for maintaining computer-based record system for assigned cases 

11. Performs other related duties as assigned.

Minimum Qualifications Required 

A Police Officer with training or training eligibility in Courtroom Prosecution or an attorney with Juris Doctorate and a member of the New Hampshire State Bar Association; trial skills in the District Court level, must be highly organized with excellent time management skills; proficient in computer usage. 

KNOWLEDGE, SKILLS, AND ABILITIES 

Knowledge of 

• Local and State government legislative process 

• Applicable state, federal and local laws, regulations and case opinions 

• Principles and practices of criminal prosecution on the District Court level 

• Methods and techniques of legal research, statistical analysis and report presentation 

Abilities to 

• Speak effectively before judges and respond to questions 

• Communicate clearly and effectively, both orally and in writing 

• Prepare and interrogate witnesses in depositions, hearings, and trials 

• Prepare and draft motions, subpoenas and other court-related paperwork 

• Independently assimilate facts and draw sound conclusions 

• Conduct thorough legal research and effectively present case 

• Read, analyze and interpret professional periodicals and journals, technical procedures and government regulations 

• Write reports, correspondence and procedure manuals 

• Solve practical problems and deal with a variety of concrete variables in situations where only limited standardization exists 

• Define and solve problems, collect data, establish facts and draw valid conclusions 

• Interpret a variety of technical instructions with abstract and/or concrete variables 

• While performing the essential functions of this job the employee is frequently required to interact with and communicate with members of the judiciary, court personnel, law enforcement community, victims and the general public

RESIDENCY REQUIREMENTS 

Because of the nature of law enforcement, and the emergency call-back requirements, all full-time sworn members of the Belmont Police Department, with the exception of the Chief, shall live in Belknap County, a contiguous town or within a 30-mile radius of the Town of Belmont, whichever is larger. The Prosecutor should live within this radius but it is not required. Prosecutor is an on-call position potentially requiring them to respond to the police station or a crime scene while off-duty.
