WORKSHOP DESCRIPTION
Join NHMA’s Legal Services Counsel Stephen Buckley and Municipal Services Counsel Jonathan Cowal who will share insights and strategies to assist law enforcement agencies in handling governmental record requests arising under the RSA 91-A, the Right-to-Know Law.
Over the past year there have been many changes to both RSA 91-A and to the application of the FOIA (Freedom of Information Act) standards as they apply to record requests. These changes have come from legislative amendments to the statutes and court cases which have altered or supplemented legal interpretation of the law as it applies to public record requests. Consequently, public record requests have become more confusing and complicated than ever, especially for law enforcement. With more changes potentially on the horizon, understanding the current and future state of RSA 91-A is of the utmost importance.
The presenters will provide an in-depth analysis of how to apply the privacy vs. public balancing test to information being requested for release, they will go over some recent caselaw and court decisions that have changed the landscape of certain aspects of RSA 91-A and FOIA, and they will also address some important strategies for mitigating the burden associated with Right-to-Know requests as well as some policies other law enforcement agencies have successfully implemented.
Attendees will receive an electronic copy of NHMA's publication, New Hampshire's Right-to-Know Law 2023. Additional materials such as the PowerPoint presentation and newly created guidance documents will also be distributed electronically. No print outs of the materials or hard copy of the publication will be provided.
Pre-registration and payment is required. You will be billed according to the pricing on the options you select at registration. If you wish to make changes, NHMA must be notified in writing at least 48 hours in advance. Refund of the full registration fee will be made if cancellation notification is received 48 hours in advance. Cancellation less than 48 hours in advance, including no-shows, will result in you being charged the full cost of the workshop. If you have made a change to your registration (from in person to virtual, for example), NHMA will adjust your invoice if we receive notification as outlined above. If you register but cannot attend, a recording of the workshop will be provided if payment has been received.
