ABOUT THE ROLE:  The Town of Salem is seeking qualified applications for the Prosecutor position which will oversee all prosecutorial functions, responsible for prosecuting Salem Police Department cases in Circuit Court and State administrative hearings.
Performing highly responsible work of a legal nature within a police agency.

ACCOUNTABILITY:  Reports directly to the Support Bureau Sergeant, the Operations Support Bureau, and the Chief of Police.

WHAT YOU’LL DO: (below is a summary, please see job description for full details.)
The Prosecutor will prepare and oversee assigned misdemeanor and violation-level cases in Circuit Court. Review reports and cases for thoroughness and completeness. Assign follow-up as required.
Handle assigned Felony-level cases through until the case is bound over to Superior Court, otherwise disposed of, or if the case is taken by the Rockingham County Attorney’s Office of Attorney General’s Office in Circuit Court.

Responsible for reviewing court cases with involved officers. Prepares officers and other required witnesses for testifying and outlining the court process. Selects necessary witnesses and evidence and supervises notification of all necessary witnesses and acquisition of all necessary evidence for court proceedings. Maintains list of police witnesses required for trials, court, and administrative hearings. Prepares court motions as needed. Prepares responses to defense pleadings. Argues cases and points of law and fact as required whether it is regarding bail, motions, trial, or sentencing.

The Prosecutor represents the agency in administrative license suspension hearings, and other proceedings as needed regarding the Division of Motor Vehicles and Bureau of Hearings. Maintains liaison role with court personnel, county attorney’s office and defense lawyers. Assists officers, including detectives, as sought on ongoing investigations, active cases and to include charging decisions and search warrants. Supplies documents and responses to inquiries as needed including discovery for Circuit Court cases. Assists with juvenile prosecution. Reviews and recommends sentencing on Circuit Court cases; considers alternative sentencing options. Consults with officers, witnesses, and victims on cases as appropriate. Reviews Supreme Court and other court decisions as to impact on police and prosecution operations. Prepares advisories, training bulletins or other appropriate means to ensure compliance with new rulings.

REQUIREMENTS: 
Completion of law degree.
Member of the New Hampshire Bar Association. Remain in good standing with the Bar to include satisfying the annual continuing legal education requirements.
Adherence to the NHBA’s Rules of Professional Conduct to include the Special Responsibilities of a Prosecutor.
Demonstrated oral and written skills. Maintain solid judgment and decision-making ability; ability to multi-task and effectively perform.
Prosecutor in emergency or stressful situations.
Prosecution and courtroom experience preferred.
Must have a valid driver’s license. 

WHAT WE OFFER:  Benefits provided by the Town are described in the SPAA Collective Bargaining Agreement, and include:

Annual paid time off – 15 days’ vacation, 12 sick days;2 personal days; 11 holidays.

Health, and Vision Insurance HSA – Employee pays:
$62.81/ week for family coverage. 
$46.50/week for 2-person coverage. 
$23.09/ week for single coverage.

Dental Insurance- Employee pays: 
$11.71/ week for family coverage.
$5.06/ week for family coverage. 
$0.00/week for single coverage. 

If an employee already has qualifying insurance, the Town will pay $5,000 annually to waive coverage.

Disability Insurance – 70% of base wages for up to 26 weeks.
Life Insurance – Equal to base annual earnings.
New Hampshire Retirement System Group I – Defined benefit pension plan.
Tuition reimbursement for pre-approved courses.

The salary range for this position is $86,784.00-$100,835.00 in accordance with SPAA CBA and dependent upon qualifications and experience. Applications will be reviewed upon receipt.
